Information on the processing of Personal Data
by Notariat Bachmann

1 Personal Data:

We process Personal Data (data that directly or indirectly identifies natural persons) that we receive from you or involved third parties within the scope of the mandate relationship or that we collect ourselves.

2 Applicable law:

This privacy policy is subject to Swiss law. The collection and processing is governed in particular by the Swiss Data Protection Act (DSG). As far as applicable, provisions of the European Union (EU), in par-ticular the EU General Data Protection Regulation (GDPR), are taken into account.

3 Responsibility:

The person responsible for the processing of Personal Data described in this data protection declaration is Daniel Bachmann, Attorney at Law and Notary Public, Schänzlistrasse 6, 4500 Solothurn.

4 Receipt/Collection of Personal Data:

As part of our client relationship, you will be required to provide such Personal Data as is necessary for us to commence and perform the legal and notarial services and to fulfill related contractual obligations. Without this data, we will generally not be able to complete a service with you (or the entity or person you represent). Also, the website cannot be used if certain information to secure traffic (such as IP address) is not disclosed. Some of the Personal Data you or the data subjects provide to us when you or said subjects contact us via email or by phone and request our services. This includes, for example, name and contact details as well as information about the role of the data subject at the company or organization for which you or the respective contact persons work or on whose behalf you or they contact us. We also process Personal Data that we receive in our correspondence with third parties (in particular clients, counterparties, cooperation partners, authorities and courts and their employees or other contact persons) in the context of the mandate relationship (e.g. name, contact data, date of birth, gender, family relationships, information on the employment relationship, income or asset situation, or state of health). Publicly known or accessible Personal Data may also be processed by us if this is appropriate for the business activity.

5 Main purpose of processing:

We process the aforementioned types of Personal Data primarily to provide, document and bill our legal and notarial services.

6 Other purposes:

In addition, we process the contact details of clients or their employees or other contacts for marketing purposes (using any means of communication such as email, social media, mail or telephone), unless the use of such data has been objected to, in order to provide information about publications, events, news, services or products that may be of interest.

7 Data disclosure:

In order to achieve the purposes described in this Privacy Policy, it may be necessary for us to disclose Personal Data to the following categories of recipients: External service providers, clients, counterparties and their legal representatives, business partners with whom we may need to coordinate the provision of legal services, and public authorities and courts.

8 Place of processing:

We process Personal Data in Switzerland. However, we may transfer the Personal Data to recipients (namely clients, coopera-tion partners, counterparties or authorities) who in turn process the Personal Data in other countries, including those that do not ensure a level of data protection comparable to Swiss law. We will do the latter based on consent or standard contractual clauses, or if it is necessary to fulfill a man-date/contract or to enforce legal claims.

9 Retention/Storage:

We only store Personal Data for as long as is neces-sary to process the mandate relationship, for as long as there is a legal obligation to retain and document the data (e.g. pursuant to art. 958 f. CO or according to § 44 ff. Notary Ordinance of the Canton of Solothurn) or there is an overriding private or public interest in doing so. As soon as the Personal Data is no longer required for the abovementioned purposes, it is delet-ed or made anonymous as a matter of principle and as far as possible. We take appropriate technical and organizational security precautions to protect Personal Data from loss, unauthorized modification or unauthorized access by third parties. If you provide us with Personal Data through a third party (e.g., through your employees or other contacts), it is up to you to inform them in a general way about the processing by legal service providers (such as us) or other external service providers (e.g. in a privacy statement for employees).

10 External services and means of communication:

We would like to point out that we use external IT service providers and cloud providers with servers in Switzerland as part of our mandate. We then use certain IT services as well as means of communication which may be associated with data security risks (e.g. e-mail, video conferencing). We assume that you are in agreement with this. It is your responsibility to inform us of your wish for special security measures. Communication by e-mail, telefax, cell phones or internet applications involves risks, such as the possibility of viewing the content of the communication, its modification or loss. Notariat Bachmann accepts no liability for this.

11 Interest:

We have a legitimate interest in the processing of Personal Data corresponding to the aforementioned purposes. Some processing is also nec-essary so that we can fulfill our contractual obligations to you or our legal obligations (e.g. retention obligations).

12 Inquiries:

In the case of inquiries of a general nature addressed to us or in the case of inquiries regarding the execution of orders or the assumption of notarial or legal mandates, the principles for the processing of Personal Data of clients in accordance with this Privacy Policy shall apply to the processing of Personal Data, even if no contractual or mandate relationship is established.

13 Right to information and objection:

Data subjects have in particular the right to information about the Personal Data stored about them and the pur-pose of the data processing, the right to rectification as well as to deletion or restriction of the processing of their Personal Data, the right to object to the processing as well as to data transfer/transferability. Individuals in Swit-zerland may report a data breach to the Federal Data Protection and Infor-mation Commissioner. If the GDPR applies, there is a right of appeal to the competent data protection supervisory authority pursuant to art. 77 EU-DSGVO. However, please note that prerequisites and exceptions apply to these rights. To the extent legally permissible or necessary, we may refuse requests to exercise these rights. Thus, we may or must retain or otherwise continue to process the Personal Data for legal reasons, despite requests to delete the Personal Data or restrict processing. This applies in particular to notarial retention and documentation obligations.

14 Subject to change:

Notariat Bachmann may amend this Privacy Policy at any time without prior notice. The current version published on the website shall apply. It is therefore recommended to consult our privacy policy regu-larly on our website (www.notariat-bachmann.ch).

15 Law firm website:

Our website (www.notariat-bachmann.ch) is based on WordPress. Only those cookies are used that are indispensable for the oper-ation of the website (technically necessary cookies). Otherwise, the website does not use cookies or analytics tools. As with any connection to a web server, the server on which we provide our website and applications auto-matically logs and stores certain technical data. This data includes the IP address and operating system of the device of the visitor to our website, the date and time of use, the website from which we are visited and the type of browser used to access our website. This data cannot be directly assigned to specific persons. A combination of this data with other data sources is not made. This data, as well as all data on this website, is stored by our hosting provider Cyon GmbH, Brunngässlein 12, CH-4052 Basel, Switzerland, whose privacy policy can be found at: www.cyon.ch/legal/datenschutzerklaerung.
